If you’re looking to work or invest in the U.S., you have several routes you can use, the most common of which are investment-based and employment-based visas. These are divided into subcategories, each with specific requirements, application procedures and benefits as highlighted below:
Investor Visas: Investor visas allow foreign nationals to obtain residency in the U.S. in exchange for an investment. There are two types of investor visas you can consider in Houston,
1. E-2 Treaty Investor Visa: This is a non-immigrant business visa that can be issued to countries with trade agreements with the U.S. E-2 Treaty investor visas allow citizens of U.S. treaty countries to reside temporarily in the U.S., establish a business, and run a business. There is no specified investment amount for the E-2 visa, but most investments range from $100,000 to $300,000.
2. EB-5 Immigrant Investor Visa: The EB-5 visa is an investor visa that is extended to investors who invest at least $1,050,000 in the economy or $800,000 if the investment is within a targeted employment area.
U.S Employment-Based Visa: You can also get an employment-based visa to live and work in the U.S.. However, before applying for the visa, your employer must file a permanent labor certification with the Department of Labor to prove that they cannot find an American worker with the right skills to fit that role.
1. Employment-Based First Preference (EB-1) Visa: This visa application is for individuals at the highest levels of their careers. It is available in three categories which are the EB-1AA for extraordinary ability, AB-1B for researchers and Academics, and EB-1C for multinational managers and executives.
2. Employment-Based Second Preference (EB-2) Visas: EB-2 visas can be issued to foreign nationals who are professionals with an advanced degree (masters or PhD) or persons with exceptional ability in various fields. This type of visa requires employer sponsorship, but applicants can also apply for an exemption through a National Interest Waiver.
3. Employment-Based Third Preference (EB-3): The EB-3 visa is available for workers with specific skills. It’s also required that the workers applying for this visa have at least two years of experience. You can also apply for the EB-3 visa if you’re a professional with a bachelor’s degree from a U.S. college or University. For unskilled workers employed in permanent jobs requirements include at least two years of training and experience to obtain an EB-3 visa.
H-1B Specialty Worker Visa: H-1B visas only grant temporary residence to foreign workers who have specialized skills or knowledge. Your employer must file the petition on your behalf, which then goes through a lottery with hundreds of thousands of others. Only the winners of the lottery are considered for this visa.
